Bible Grow End User License Agreement

This End User License Agreement (“EULA”) is a binding agreement between the User and Etara Innovations Limited concerning the Bible Grow application and related updates, content, and services. The EULA is concluded between the User and Etara Innovations Limited only, not with Apple Inc. or its affiliates. Etara Innovations Limited, not Apple, is solely responsible for Bible Grow and its content.

By downloading, installing, or using Bible Grow, the User accepts this EULA together with the Bible Grow Terms of Use, Privacy Policy, and other policies incorporated by reference.

The User represents that they have legal capacity to accept this EULA. A minor may use Bible Grow only with any consent required by applicable law.

Subject to compliance with this EULA, Etara Innovations Limited grants the User a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use Bible Grow on compatible devices the User owns or controls for personal, non-commercial use.

For an Apple-distributed copy, the license is limited to use on Apple-branded products owned or controlled by the User and as permitted by the Apple Media Services Usage Rules, except that the application may be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing where those rules permit.

Bible Grow is licensed, not sold. Etara Innovations Limited and its licensors retain all right, title, and interest in the application, source code, object code, databases, design, branding, documentation, original editorial content, and related intellectual property.

Except where applicable law expressly permits otherwise, the User must not copy, distribute, sell, rent, lease, lend, sublicense, reverse engineer, decompile, disassemble, attempt to derive source code, modify, create derivative works, remove proprietary notices, bypass security controls, interfere with service operation, or use automated means to extract data without authorization.

Open-source components remain governed by their applicable licenses, and those licenses prevail where they grant rights that cannot be restricted by this EULA.

Certain features require an account. Users are responsible for safeguarding credentials and for lawful use of the account.

Users retain ownership of User-Generated Content. The limited content license in the Terms of Use applies to content submitted through Bible Grow.

AI-assisted responses are educational aids and can be inaccurate or incomplete. They are not Scripture, divine revelation, professional advice, emergency services, or a substitute for pastors, churches, or qualified professionals.

Etara Innovations Limited is solely responsible for maintenance and support services for Bible Grow to the extent required by applicable law or expressly promised in writing. Apple has no obligation to provide maintenance or support for Bible Grow.

Bible Grow may enable access to third-party services, authentication providers, websites, or content. The User must comply with applicable third-party terms. Etara Innovations Limited does not control independent third-party services and is not responsible for their content, availability, or practices except where liability cannot lawfully be excluded.

The User must comply with applicable wireless-data and carrier terms when using the application.

Bible Grow processes personal and technical information as described in the Privacy Policy. The Privacy Policy explains purposes, categories, service providers, international processing, retention, security, and user rights.

Etara Innovations Limited may provide updates, patches, and new versions. Updates that replace or supplement the application are governed by this EULA unless accompanied by separate terms. Some updates may be required for continued use, security, or compatibility.

This EULA remains effective until terminated. The User may terminate it by ceasing use and deleting the application and account. Rights under this EULA terminate automatically upon material breach. Account suspension or termination under the Terms of Use also terminates the software license.

To the fullest extent permitted by law, Bible Grow is provided “as is” and “as available.” Etara Innovations Limited is responsible for any product warranties that cannot lawfully be disclaimed. Apple has no warranty obligation regarding Bible Grow.

Etara Innovations Limited, not Apple, is responsible for addressing claims relating to Bible Grow, including product-liability claims, claims that the application fails to conform to legal or regulatory requirements, and claims arising under consumer-protection, privacy, or similar legislation, subject to this EULA and applicable law.

If an Apple-distributed copy fails to conform to an applicable warranty, the User may notify Apple, and Apple may refund the purchase price, if any, in accordance with Apple’s terms. To the maximum extent permitted by law, Apple has no other warranty obligation.

To the fullest extent permitted by law, Etara Innovations Limited is not liable for indirect, incidental, special, consequential, exemplary, punitive, or loss-of-profit damages arising from the application. Nothing excludes liability that cannot legally be excluded.

To the extent permitted by law, the User will indemnify Etara Innovations Limited against third-party claims arising directly from unlawful use, infringing content, or material breach of this EULA.

The User must comply with applicable export-control and sanctions laws, including the laws of the jurisdiction in which the application was obtained. The User represents that they are not prohibited from receiving or using the application under applicable restrictions.

For United States Government end users, the application and documentation are commercial items and are licensed only with the rights granted to other users under this EULA.

This EULA is governed by the laws of the Republic of Uganda, without regard to conflict-of-laws principles. Before commencing formal proceedings, the parties will make reasonable good-faith efforts to resolve the dispute through direct communication.

If the dispute remains unresolved, the competent courts of the Republic of Uganda have jurisdiction. Nothing in this clause deprives a consumer of mandatory rights or a mandatory forum available under the law of the consumer’s habitual residence.

Etara Innovations Limited is not responsible for failure or delay caused by events beyond its reasonable control. It will make reasonable efforts to restore affected services as circumstances permit.

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. The User may not assign this EULA without written consent. Etara Innovations Limited may assign it in connection with a lawful corporate transaction. This EULA and incorporated policies constitute the entire agreement concerning the software license.

Apple and its subsidiaries are third-party beneficiaries of this EULA for Apple-distributed copies. Upon the User’s acceptance, Apple has the right to enforce this EULA against the User as a third-party beneficiary.

Etara Innovations Limited, not Apple, is responsible for investigating, defending, settling, and discharging any third-party intellectual-property infringement claim relating to Bible Grow.
